SMS Terms & Conditions and Privacy Policy

​Effective Date: October 2025

These Terms & Conditions (“Terms”) govern your receipt and use of SMS/text messages (“Messages”) from ICM via the EveryAction mobile messaging service (the “Service”). By opting in, you agree to these Terms.

1. Consent & Opt-In

1.1 Voluntary Participation. By submitting your mobile phone number and opting in (e.g., texting a keyword, checking a box, etc.), you consent to receive Messages from ICM using EveryAction’s SMS/MMS service.

1.2 Scope of Consent. You agree that ICM may send you periodic promotional, informational, or transactional text messages (including links) related to ICM, campaigns, events, fundraising, advocacy, updates, or relevant activities.

1.3 Carrier & Messaging Rates. Your carrier’s normal message and data rates may apply. You are responsible for any charges imposed by your mobile provider.

1.4 Message Frequency. The number of messages may vary. ICM will make reasonable efforts to communicate expected frequency (e.g., “up to 4 messages/month”) at the time of opt-in.

 

2. Opt-Out / Stop / Help

2.1 STOP to Unsubscribe. You may opt out of receiving further Messages at any time by replying “STOP” (or another designated keyword). After receiving a valid STOP request, ICM will send a confirmation and you will no longer receive promotional messages (though transactional messages may persist, if permitted).

2.2 HELP or INFO. You may reply “HELP” (or another designated keyword) to receive instructions or contact support (e.g. an email or phone number).

2.3 Re-Opting In. If you later wish to resubscribe, you may opt in again by texting a designated keyword or following other instructions provided by ICM.

 

3. Message Content & Use

3.1 Appropriate Use. ICM will not send any unlawful, harassing, defamatory, or otherwise objectionable content via Messages.

3.2 Keyword Handling. ICM may use keywords (e.g., “GIVE”, “JOIN”) to trigger automated responses or workflows via EveryAction. Use of those keywords constitutes your consent to that action.

3.3 MMS / Media Messages. Messages may contain images, audio, video, or other media (i.e. MMS). Your carrier must support MMS to receive media-based messages; if not, you will receive text-only.

3.4 Links & Third-Party Content. Messages may include links to external websites or donation pages. These external sites may have their own terms, privacy rules, or security systems; ICM is not responsible for third-party content or practices.

 

4. Data & Privacy

4.1 Data Use. ICM collects certain data (phone number, message interaction, opt-in/opt-out status, timestamps, etc.) to operate the Service, monitor delivery, measure engagement, manage your subscription, and improve messaging effectiveness.

4.2 Storage & Security. Collected data will be stored securely (e.g. in EveryAction’s systems or affiliated infrastructure). ICM will implement reasonable administrative, technical, and physical safeguards to protect this data from unauthorized access.

4.3 Sharing with Partners. ICM may share data internally (within ICM’s divisions) or with service providers (e.g. EveryAction / Bonterra) to facilitate message delivery, analytics, or campaign operations. Data will not be sold to third parties outside of service needs.

4.4 Retention Period. ICM will retain messaging data for as long as necessary for operational, legal, or audit purposes (for example, [7 years]) unless you request deletion (subject to applicable law).

 

5. Disclaimer & Limitation of Liability

5.1 No Guarantee. ICM does not guarantee that all Messages will be delivered, received, or read. Factors such as carrier filtering, device issues, or network outages may interfere.

5.2 Disclaimer of Warranties. THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED (including warranties of merchantability, fitness, non-infringement, or uninterrupted service).

5.3 Limitation of Liability. To the maximum extent permitted by law, ICM shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages arising from or related to the Messages, even if advised of the possibility of such damages. In jurisdictions that limit limitations, liability shall be capped at the amount paid (if any) by you for the Service during the prior 12 months.

 

6. Changes & Updates

ICM may revise these Terms at any time. If changes are material, we will provide notice (e.g. via Message or email) before they take effect. Continued receipt of Messages after changes constitutes your acceptance.

 

7. Compliance with Law

ICM and all Message transmissions shall comply with applicable laws and regulations governing SMS/MMS communications, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, CTIA rules, and state-level messaging or consumer protection laws.
